2. POPIA section 18 collection notice

We collect most information directly from you through the customiser, basket, checkout, post-payment order confirmation, emails and support requests. Shopify may collect device, browser, IP, cookie, checkout and fraud-prevention data automatically. Transaction, payment-status, manufacture, delivery and support information may also be generated by or received from Shopify, the active payment provider or bank, our supplier, printing and fulfilment partners, courier and technical service providers.

The first and last name, email address, complete South African delivery address, shipping telephone number, product and personalisation choices, and payment or transaction information required by checkout are mandatory for an order. Address line 2 is optional. We use the mandatory information to form and perform the contract, manually confirm the paid design, size and delivery details, personalise and quality-check the order, process payment, prevent fraud, deliver, provide support, keep required records and comply with legal duties. If it is missing or materially inaccurate, checkout or fulfilment may fail.

A customer account is optional. Marketing consent is also optional and separate from necessary order or service messages. Refusing or withdrawing marketing consent does not prevent an order or reduce service; it means we will not send consent-based marketing. Optional analytics or marketing cookies are governed by available storefront choices.

3. Information we collect

  • Identity and contact details, including name, email, shipping telephone number and delivery address.
  • Order and personalisation details, including colour, size, surname, number, design identifier, edition, estimated delivery window and support history.
  • Payment and transaction status supplied by Shopify and the active payment provider. WARCRY does not receive your full card number or security code.
  • Device, browser, IP address, cookies and storefront interaction information collected through Shopify and any enabled analytics or fraud-prevention tools.
  • Marketing consent, unsubscribe status and the source and date of that consent.

4. Why we use it

  • To create, manually confirm, personalise, assemble, quality-check, pack, dispatch, deliver and support your order, including one handwritten thank-you note with each individual tee.
  • To take payment, prevent fraud, keep financial and transaction records, and process refunds.
  • To communicate order confirmations, dispatch updates, service messages and requested support.
  • To send marketing only where lawful, including where valid consent exists and subject to your right to object or unsubscribe.
  • To secure, troubleshoot and improve the store and to comply with law, regulators, disputes and legal claims.

5. Lawful processing

We process personal information where it is necessary to perform or prepare the customer contract, comply with legal duties, protect legitimate interests that do not override your rights, or act on valid consent where consent is required. You may withdraw consent for future consent-based processing without affecting earlier lawful processing.

6. Who receives information

We share only the information reasonably needed with service providers that help operate the store, including Shopify, the active payment provider, the Cape Town supplier where required, the Pretoria personalisation and fulfilment operation, our appointed delivery provider, email and technical providers, and professional advisers. We may also disclose information where required by law or a competent authority.

7. Cross-border processing

Shopify and other technology providers may process or store information outside South Africa. Where personal information is transferred across borders, we use providers and arrangements intended to provide an appropriate level of protection as required by POPIA.

8. Cookies and storefront technology

Shopify and enabled service providers use cookies and similar technologies for essential store functions, security, the basket, checkout, fraud prevention, order status and preferences. Analytics or marketing technologies are used only where enabled and subject to applicable privacy controls. Available cookie and privacy controls are presented through the storefront or browser. Blocking essential cookies may prevent the customiser, basket or checkout from working.

  • Essential storefront and checkout cookies support the service you request.
  • Preference cookies may remember selected settings where enabled.
  • Analytics cookies may help measure store performance where enabled.
  • Advertising or retargeting cookies are used only if intentionally enabled and lawfully configured.

9. Direct marketing

Marketing is separate from necessary order and service messages. We use electronic contact details for marketing only where the person has consented or, for an existing customer, where every condition of POPIA section 69(3) is met for our own similar products or services. Prelaunch interest alone does not make someone an existing customer. Every marketing message provides a free, simple way to unsubscribe. You can object at any time by emailing warcryoperations@gmail.com.

10. Retention

We keep personal information only for as long as reasonably needed for orders, support, accounting, legal compliance, dispute handling and legitimate business records. We then delete, anonymise or securely archive it unless law requires longer retention.

11. Security

We use reasonable administrative, technical and organisational safeguards and reputable commerce and payment providers. No internet system is risk-free. If a security compromise creates a notification duty, we will follow applicable legal and regulatory requirements.

12. Your rights and PAIA requests

Subject to POPIA and PAIA, you may request access to or correction of personal information, ask for deletion where legally available, object to certain processing, withdraw consent, or complain about processing. We may need to verify identity before acting and may retain records where law permits or requires it.

13. Children

Only a purchaser who is at least 18 years old and legally able to place an order may complete checkout. If the wearer or recipient is a minor, or any personal information submitted for the order concerns a minor, the purchaser must be that minor’s parent or legal guardian and must authorise the processing necessary to confirm, make, deliver and support the order. Marketing concerning a minor requires separately valid parent or legal-guardian consent and is never inferred from an order or post-payment service confirmation.
